P.C.:- The Petitioner herein has challenged the order dated 12th January, 2017 passed by the learned Judicial Magistrate, First Class, Court No.2, Vashi, without approaching the Sessions Court. The Petitioner has efficacious alternative remedy. 2.

In view of above, the learned counsel for the Petitioner, under instructions, seeks leave to withdraw the Petition with liberty to file appropriate proceedings before the Sessions Court with application for condonation of delay, if necessary. Leave with liberty as prayed for is granted.
