Heard learned counsel for the parties.

As per the order passed by this Court on 13th December 2013, the ad-interim stay was granted to the execution of the impugned Judgment and Award dated 2nd August 2013 passed by M.A.C.T., Thane in M.A.C.P. No.32 of 2009, subject to deposit of the amount under the Award by the applicant-Insurance Company in the Tribunal.

Office record also shows that the entire amount under the Award, as calculated by the applicant-Insurance Company towards satisfaction of the claim, is already deposited in the Tribunal within the stipulated period. 1/2 CAF-4731-13==.doc

In view thereof, the order of ad-interim stay, granted earlier by this Court, is made absolute.

The amount of Rs.25,000/- deposited in this Court by the appellantInsurance Company is directed to be transferred to M.A.C.T., Thane in M.A.C.P. No.32 of 2009. The M.A.C.T., Thane is directed to invest the said amount in any Nationalized Bank, initially for a period of one year, to be renewed from time to time, till disposal of the First Appeal. 6.
