The applicant is seeking bail in CR No.197/2015 registered with Khar Police Station, Mumbai under Section 307 read with 34 of the I.P.C. And under sections 3,25 and 27 of the Arms Act.

2) The learned counsel for the applicant submits that the co-accused who has been alleged to have fired from the fire arm namely Shafi Sayyed has been released on bail by this court by an order dated 4/12/2015. He submits that the role attributed to the present applicant in the First Information Report is lessor than the said co-

2 /2 BA-2418-15 accused. He further submits that the principle of parity is applicable to the present applicant. The learned APP fairly concedes to the said position. 3) In view of the above, the applicant is entitled to be released on bail. Hence, the following order.

ORDER

a) The applicant shall be released on bail in CR NO.197/2015 registered with Khar Police Station, Mumbai on his furnishing PR bond of Rs.1,00,000/- with one or two solvent sureties in the like amount.

b) After his release from Jail, the applicant shall report to the Khar Police Station, Mumbai between 10.00 a.m. and 12.00 noon on every first Monday of the month till the conclusion of the trial. c) The applicant shall not tamper with the prosecution evidence and/or influence the prosecution witnesses.

d) The applicant shall furnish documents of his residential address and mobile no. to the Investigating Officer.

e) Application is allowed in the aforesaid terms. (A.S. GADKARI, J.)
