Learned counsel for the applicant submits that he may be allowed to withdraw this application with liberty to prefer fresh application before the Court of Magistrate. It is submitted that earlier application was rejected by the Special Court with observations that investigation is in progress. It is therefore submitted that applicant would prefer a fresh application before the trial Court.

In view of the submission, applicant is allowed to withdraw this application with liberty to prefer fresh application before the trial Court. In the event the applicant prefers fresh application, the trial Court shall decide the same in accordance with law. This Court has not expressed any view on the merits of the case. 3.
