By the above Civil Application, the Applicants seek condonation of delay of two days in filing the Second Appeal. The Respondent No.1 is represented by his Advocate, however, today none appeared for the Respondent No.1. The Respondent No.2 has passed away. The Respondent No.3 is the brother of the Respondent No.2 who is served, but is not present in Court. For the reasons set out in the paragraph Nos.3, 4 and 5 of the Civil Application, delay is condoned. 2.

Office is directed to number the above Second Appeal if all the other objections raised by the office are removed.

A copy of the Second Appeal as well as a copy of this Order shall be served on the Advocate for the Respondent No.1 and on the Respondent No.3 by Speed Post/Registered Post A.D. and/or by hand-delivery and an affidavit proving service shall be filed before the adjourned date.

The Order dated 15 th February, 2017 shall continue upto 02.08.2017. 5.

The above Civil Application No.249 of 2017 is accordingly disposed off. 6.
