CIVIL APPELLATE JURISDICTION CONTEMPT PETITION NO. 73 OF 2016 IN WRIT PETITION NO. 8346 OF 2010 Mahesh Babulal Panchal ..Petitioner versus Shree Kshetra Mahabaleshwar Devasthan Trust, through its Trustees & Ors.
..Respondents None for Petitioner.
None for Respondents.
CORAM: S. C. DHARMADHIKARI & SMT. BHARATI HARISH DANGRE, JJ.
DATE : 31ST JANUARY, 2018 P. C. :
1] The contempt petition is filed on 4th December 2015 alleging civil contempt for non compliance with the order dated 10th June 2014. 2] The petitioner alleges that the order passed by this Court directs consideration of the issue particularly mentioned in the said order. That has not been complied with.
3] On the earlier occasion and even today the petitioner and the Advocate is absent. None is present to inform the Court as to whether the order has been complied with albeit belatedly. Once the basic ingredients of the civil contempt are lacking then, we are not obliged to entertain this petition. It is dismissed but without any order as to costs. (SMT. BHARATI H. DANGRE, J.) (S.
