After the present Applicant was released in Crime No. 210 of 2011 for an offence punishable under Sections 395 and 363 of the Indian Penal Code, since he remained absent before the Sessions Court, Nonbailable warrant came to be issued against him in November 2016. 2.

When the Applicant appeared before the court of learned Sessions Judge, he was taken into custody on 13th November, 2017. 3.

Perused the impugned order dated 19th July 2018 and the report issued by the Assistant Professor, Department of Psychiatric,

2/2 Yadav 24.ba.2906.18 Government Medical College and Sasoon Hospital, Pune. In the aforesaid background, the learned Counsel for the Applicant assures that the Applicant shall attend the trial on day to day basis and will not seek any adjournment. Since the statement is made on instruction same is accepted as an undertaking.

In view thereof, it is ordered that the Applicant be released on same conditions on which he was earlier ordered to be released in Crime No. 210 of 2011 punishable under Sections 395 and 363 of the Indian Penal Code.

Single default in presence of the Applicant before the Sessions Court will entail the Sessions Court to take a call whether to cancel the bail of the Applicant, if the absence is for unjustifiable reason. 6.

The Criminal Bail Application stands disposed of with liberty to Sessions Court to take out the proceedings. (NITIN W. SAMBRE, J.)
