The learned counsel appearing for the Respondents makes statement that "the Respondents will incorporate a condition in the new tender to be floated hereinafter, that the Small Scale Industry registered under the Micro, Small and Medium Enterprises Development (MSMED) Act, 2006 is exempted from furnishing the Earnest Money Deposit (EMD) while submitting a tender of mechanical branch". ssm 2 910-wp11556.14.sxw this, we are inclined to dispose of the present Writ Petition, as the main grievance has been redressed in view of the above statement and even otherwise, the tender period itself is over. Writ Petition is accordingly disposed of. Rule discharged accordingly. Interim relief granted on 21 October 2015, is vacated. Respondents to proceed in accordance with law. No costs.
