IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 16634 OF 2023 Sampada Sadanand Pedhavi alias Smt. Sampada Narendra Tekade ...
Petitioner versus State of Maharashtra and Others ...
Respondents .......
Mr.R.K.Mendadkar for the Petitioner.
Mr.V.M.Mali, AGP for Respondent Nos. 1 to 3-State. .......
CORAM : NITIN JAMDAR & M.M.SATHAYE, JJ.
DATE : 8 JANUARY 2024 P.C.:
Heard the learned Counsel for the parties.
2.
The Petitioner asserts that she is granted a certificate of validity on 28 May 2012, but the Petitioner is before us because her employer, Bhabha Atomic Research Centre ( BARC ), has issued notice to her on 18 August 2023 informing that "Koli Mahadeo" is not listed as Scheduled Tribe appended to the Constitution of India, but "Koli Mahadev" is.
3.
The learned Counsel for the Petitioner states that this is a clerical error in the validity certificate for which the Petitioner has
Trupti 2 17-wp-16634-2023.doc applied to the concerned Sub Divisional Officer, Alibaug and the Scrutiny Committee, however, there is no response. 4.
The learned AGP submits that if the Petitioner tenders the original caste certificate to the Sub Divisional Officer and the certificate of validity to the concerned Scheduled Tribe Scrutiny Committee, necessary corrections in the documents would be carried out.
5.
If the Petitioner so tendered these documents, necessary description be taken by the Sub Divisional Officer and the Scrutiny Committee within a period of four weeks thereafter. 6.
We make it clear that we are proceeded on the Petitioner's assertion that the Petitioner has been duly granted the caste certificate and the certificate of validity as we have had no opportunity to see the original copies.
7.
The writ petition is accordingly disposed of. (M.M.SATHAYE, J.) (NITIN JAMDAR, J.)
