IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION CONTEMPT PETITION NO.19 OF 2015 IN WRIT PETITION NO.143 OF 2011 Smt Smita Chandrakant Shah and Anr.

... Petitioners

Versus

The State of Maharashtra and Ors.

... Respondents Mr. Rompal Singh Kohli for the Petitioners.

Mrs. M.P. Thakur, AGP for the Respondent Nos.1 to 5. CORAM : A.S. OKA & G.S. PATEL, JJ.

DATE : 14th DECEMBER, 2015 P.C.

1.

The learned AGP has placed on record a copy of the order dated 21st November, 2015 passed by the District Collector. It is taken on record and marked 'A-1' for identification. Though belatedly, the order dated 28th February, 2012 passed by this Court has been complied with, it cannot be said that the Collector has committed a willful breach of the order of this Court. Accordingly, no case is made out to take an action under the Contempt of Courts Act, 1971. 2.

If the Petitioners are aggrieved by the order dated 21st November, 2015, they can always adopt appropriate remedy in accordance with law. All contentions in that behalf are kept open. (G.S. PATEL, J ) (A.S. OKA, J )
