This is an application for relaxation of condition imposed on the applicant vide order dated 23/07/2012 passed in Criminal Bail Application No.997 of 2012. The applicant was granted bail by this Court (Coram: R. C. Chavan, J.) in connection with C.R.No. I 38 of 2012 registered with Bhiwandi Taluka police station. One of the conditions was that the Applicant was to stay outside Bhiwandi Taluka till the trial is over and he was not to enter Bhiwandi except for attending the Court. lookafter her. More than 12 years have passed. There is no progress in the trial except framing of Charge. The Charge was framed 6 years ago and there is no further progress in the trial. Considering this inordinate long period, learned counsel for the Applicant prays for relaxation of that condition. 2.
I have considered these submissions. The period from passing of the order imposing condition is more than 10 years. There are no allegations that the applicant had breached that condition. His mother is old. He needs to look-after her. Considering all these aspects, the condition restricting him from entering Bhiwandi Taluka till the trial is over can be relaxed. 3.
Hence, the following order:
O R D E R
i)The Application is allowed.
ii)The condition imposed in the order dated 23/07/2012 in Criminal Bail Application No.997 of 2012 directing the Applicant not to enter
Bhiwandi Taluka is deleted.
iii)The Applicant shall co-operate with the expeditious disposal of trial.
iv)The Application is disposed of.
