Heard Shri Prakash Naik, the learned counsel for the applicant. Heard Shri A.R.Patil, the learned APP for the State. I have been taken through the evidence and the relevant part of the impugned judgment. The learned APP, among other things, submitted that there are nine other criminal cases which are pending against the applicant. It is submitted that a case in avk 1/2
3-APPA-1522-2015.doc respect of an offence punishable under Section 307 of the IPC has been registered against the applicant on 31st May 2015, and since then, the applicant is not available to the police. Under these circumstances, and keeping in mind the nature of evidence against the applicant which can be minutely gone into only at the time of final hearing of the appeal, I am not inclined to suspend the sentence imposed upon the applicant. The application is rejected.
On prayer of Shri Naik, it is directed that the hearing of the appeal shall be expedited.
Liberty to the applicant to furnish a private paper book.
Liberty to the applicant to move the court for getting a date for the Final Hearing of the appeal fixed, after the paper book is furnished and after the Record and Proceedings are received.
