The previous Petition viz. Criminal Writ Petition No.2764 of 2021 was withdrawn with liberty to approach the Trial Court for appropriate relief. Leave was granted and the Petition was dismissed as withdrawn, with liberty as prayed for. 2.

Learned Advocate for the Petitioner now contends that the Petitioner has received certain documents which includes the statement of the complainant recorded by the same Police Station prior to registration of the present First Information Report (for by SUNNY ANKUSHRAO THOTE Date: 2023.12.07 16:57:24 +0530 SUNNY ANKUSHRAO THOTE short 'FIR') wherein she has indicated that she has no grievance against the Petitioner. Pursuant to Order dated 5th August, 2022 Sunny Thote

12-WP-3728-2023.doc charge has been framed against Petitioner. In view of change in circumstances, this Petition may be entertained and the proceedings may be quashed.

It is pertinent to note that the FIR and the charge-sheet were under challenged before this Court in the previous Petition which was withdrawn with liberty as stated above. Thereafter, charge has been framed. Pursuant to framing of charge we are not inclined to entertain the Petition for quashing of chrage-sheet. 4.

Learned counsel for the Petitioner also made a grievance that the victim is not attending the Court. Hence, there is no progress in trial. The trial Court may be directed to conclude the trial expeditiously.

Petition is dismissed. Trial is expedited.
