Heard learned advocate for the Applicant and learned APP for the Respondent-State. I have perused the records. 2.

This is an application for modification of condition no.7(iii) imposed while deciding the Applicant'

s bail application vide order dated 05/11/2019 (Criminal Bail Application No.3082/2018). The condition no.7(iii) is extracted hereinbelow :- " (iii)The applicant shall report Economic Offences Wing, Pune once in a month on every first Saturday between 10 am and 12 noon till further orders. " 1/3

In this application, it is stated that now the trial has commenced. The attendance of the Applicant, as directed, may not be necessary. It is brought to the notice of this Court that this condition be modified and the Applicant be directed to attend the concerned police station once in three months.

Learned APP submits that the said condition was imposed considering the gravity of the crime. The learned APP further submits that no case is made out to modify the condition. 5.

The bail was granted on 05/11/2019. There is no grievance about non-compliance of the conditions mentioned in the order. It is undisputed that now the trial has commenced. One witness has been summoned. In my view, considering this factual position, the condition no.7(iii) can be modified as prayed for.

Accordingly, the condition no.7(iii) of the order dated 05/11/2019 is modified. The Interim Application is allowed in terms of prayer clause (a) which is reproduced below :- 2/3

" a) The order of 5.11.2019 passed in criminal Bail application no. 3082 of 2018 to the extent that applicant may kindly be permitted to attend the concerned police station once in a 3 months instead of once in first Saturday of every month. "

7. Interim Application stands disposed of.
