This is an application under Section 439 of Code of Criminal Procedure for bail in C.R. No. 565 of 2018 dated 10th October 2018 registered with Baramati Taluka Police Station, under Section 307, 452, 504, 506, 507 of the Indian Penal Code and under Section 4(25) of Arms Act.

Heard learned Counsel for the Applicant and the learned APP. Perused the charge-sheet.

The medical certificate seized by the Investigating

Agency during the course of investigation indicates that the first informant did not receive any injury in the present crime and therefore, the application of Section 307 of the Indian Penal Code is misplaced. The Applicant is arrested on 10th October 2018. The investigation of the present crime is practically on the verge of completion.

In view of the above, the Applicant is entitled to be released on bail.

Hence the following order :

(a) The Applicant be released on bail in C.R. No. 565 of 2018 dated 10th October 2018 registered with Baramati Taluka Police Station, Baramati on his furnishing PR bond of Rs.20,000/- with one or two solvent local sureties in the like amount. (b) After his release from the jail, the Applicant shall attend the concerned Police Station on every 1st alternate Monday of the month between 10.00 a.m. and 12.00 noon till submission of final report and after the final report or the charge-

sheet is submitted, the Applicant shall attend the Baramati Taluka Police Station on every 1st Monday of the month between 10.00 a.m. to 12.00 noon.

(c) Applicant shall not tamper with the evidence and / or influence the prosecution witnesses. 5.
