The petition is filed seeking direction to the respondent No.3-Divisional Commissioner, Pune Division, Pune, to consider the petitioners' representation dated 30th October, 2017, a copy of which is annexed at "Exhibit F", page 44.

The learned counsel for the petitioners, on instructions, makes a statement that the respondent No.3 has already taken cognizance of the said representation/complaint and notices were issued to all concerned. In that view of the matter, we are not inclined to entertain this petition.

The learned counsel for the petitioners submitted that during the pendency of the said representation, direction may be given to Shubhada S Kadam 1/2
19 wp 13691.17.doc maintain status-quo in respect of the land which is in possession of the petitioners. We are unable to grant such prayer. The petitioners, in this regard, is however at liberty to make an appropriate application before the Divisional Commissioner. In the event, such an application is filed, the Divisional Commissioner shall decide the same independently on its own merits and in accordance with law.
