The Maharashtra Medical Council has conducted a preliminary inquiry against the Petitioner-Doctor who was allegedly negligent whilst performing the surgery on a patient named Balasaheb Haribhau Dendge. The Petitioner has in the present Writ Petition sought several reliefs. Since, the inquiry is not concluded, we are not inclined to pass any orders in the Writ Petition and we grant liberty to the Petitioner to impugn the fnal order passed by Respondent No.5, if the same is adverse to the Petitioner. However, since the Petitioner states that he needs copies of OPD notes as well as OPD/IPD records of the patient, the Advocates for the Respondents have no objection to the same. 902.wp.12206.2019.doc Advocate appearing for Respondent Nos.2 and 3, states that the required records may be with Sasoon Hospital, Pune who had carried out the preliminary inquiry. The Deputy Medical Superintendent, Sasoon Hospital, Pune who is present in Court states that photocopies of the records may be available with them. In view thereof, Sasoon Hospital, Pune shall hand over photocopies of notes of OPD and OPD/IPD records to the Petitioner within a period of four days from the date of receipt of this order. Needless to add that if the documents are not with Sasoon Hospital, Pune but are available with Respondent Nos.2 and 3, the copies of the same shall be handed over to the Petitioner by Respondent Nos.2 and 3. The Writ Petition is accordingly disposed of.
