The grievance of the applicant in the investigation agencies seems to be taking undue advantage of himself being in custody of the police, without informing either to him or to his relatives taking his custody in another crime registered with the different police station. It is his grievance that the same defies his right to not to get arrested without there existing sufficient material warranting his arrest in said crime. Vishal 1/2

The learned counsel for the applicant upon instructions states that presently the applicant is in custody of Silvasa police station in connection with C.R. Nos.98 of 2014, 99 of 2014, 18 of 2014 and 250 of 2013.

Having regard to the said submission and having due regard to the right of the applicant in view of the provision of Section 41(a) of Code of Criminal Procedure and so also the right of investigation agency, this application is disposed of with the direction that in event of any of the police station intends to seek custody of the applicant from the remand Court concerned with the aforesaid crime numbers, 24 hours advance notice be given by the said police station to the applicant/his relatives regarding themselves taking out such motion for obtaining custody of the applicant. Application stands disposed of.
