P.C. :- The Appellant challenges the dismissal of Notice of Motion by order dated 7 August 2012. The Notice of Motion was taken out for injunction in respect of a garage, which is passed almost four years back. The Suit filed by the Appellant is pending. It is clarified that the observations made in the impugned order are prima-facie and the Suit will be decided on its own merits by the City Civil Court. The Appeal from order and Civil Application are accordingly disposed of. (N.M. Jamdar, J.)
