This is an application for bail in C.R. No. 248 of 2019 registered with Ranjangaon MIDC Police Station, Pune Rural under Section 498-A, 306, 323, 504 & 506 of Indian Penal Code (for short "IPC").

Prosecution case is that, the complainant is the mother of victim. The marriage of the victim and applicant was performed on 19th March, 2012. About 7 Lakhs were spent in the marriage. The victim and applicant resided together with co-accused. The victim was forced to leave the house by other accused. Attempts were made to reconcile the dispute. Mediation had failed. The

applicant had harassed the victim. In 2014, the victim had delivered son. The applicant was demanding money for constructing house. The harassment continued. The victim committed suicide on 15th July, 2019.

The co-accused i.e. mother-in-law, brother-in-law, cousin of applicant and his wife were impleaded as accused. They had preferred an application for anticipatory bail before this Court which was allowed by order dated 30th August, 2019. 4.

Learned counsel for the applicant submitted that the allegations are vague in nature. The marriage between victim and applicant was performed in 2012. There was one issue out of wedlock. The applicant is in custody since last two years. 5.

Learned APP submitted that specific allegations are made against the applicant about harassment and cruelty to victim. She was compelled to commit suicide.

The First Information Report was lodged by the mother of the victim. It is alleged that the accused were demanding money and caused harassment to victim. The co-accused were granted anticipatory bail. The applicant was arrested in July, 2019 and for a period of two years, he is in custody. Further detention of the applicant is not necessary. Bail can be granted to the applicant.

Hence, I pass the following order:

ORDER

(i) Criminal Bail Application No. 3316 of 2019 is allowed; (ii) The applicant is directed to be released on bail in connection with C.R. No. 248 of 2019 registered with Ranjangaon MIDC Police Station, Pune Rural, on executing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount;

(iii) The applicant shall report concerned Police Station once in three months on first Saturday of the month between 11:00 a.m. to 1:00 p.m. till further order;

(iv) The applicant is permitted to furnish provisional cash bail in the sum of Rs.25,000/- for a period of eight weeks in lieu of surety.

(v) Application stands disposed of accordingly.
