This is an application for Bail in connection with C.R. No. I-257/2018 registered with Vishrantwadi Police Station, Pune for offences punishable under Sections 307, 506, 201 and 34 of IPC. 2.

The prosecution case is that the injured was assaulted by the applicant on 14th August, 2018. It is alleged that there was dispute between the applicant and the sister of the injured. Subsequently there was break up. On the date of the incident the applicant assaulted the victim by weapon.

The applicant was arrested on 13th June, 2019. Investigation is completed and the charge sheet is filed.

The statement of the victim was recorded on 28th August,

2 of 3 920-ABA-3318-19.doc 2018. He was discharged from the hospital on 17th August, 2018. There is no other eye witness to the incident. There are no criminal antecedents against the applicant. The victim had suffered about five injuries. The type of injuries are simple in nature. The victim was discharged from hospital.

Learned APP submitted that the assault is brutal. The accused was armed with chopper and blow was given on the head. The victim had sustained five injuries. The accused had sprinkled spray in the eyes of injured. There is recovery of weapon from the applicant. 6.

Investigation is completed and charge-sheet is filed. In the light of the circumstances stated herein, on certain terms and conditions the applicant can be granted bail. 7.

Hence, I pass the following order.

O R D E R

i) Bail Application No. 3318 of 2019 is allowed; ii) The applicant is directed to be released on bail in connection with C.R. No. I-257/2018 registered with Vishrantwadi Police Station, Pune on furnishing P. R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount;

3 of 3 920-ABA-3318-19.doc iii) The applicant shall stay out of the jurisdiction of the Vishrantwadi Police Station, Pune till conclusion of the trial.

iv) The applicant shall not approach the victim or his family members during the pendency of the trial and shall not tamper with the evidence; v) Bail Application stands disposed of accordingly. (PRAKASH D. NAIK, J.)
