This is an Application for modification and/or relaxation of the condition imposed upon the Applicants by an order dated 27th November 2015 while releasing the Applicants on bail. 2.
The condition No.1 of the said order reads as under :- "(i) The applicants shall be released on bail on their furnishing P.R. The learned counsel for the Applicants submitted that, though the order was passed on 27th November 2015, the applicants are unable to get the solvent sureties in the like amount. He therefore submits that the said amount of Rs.5/- Lakhs may be reduced so that the Applicants will be able to furnish sureties in compliance with the said order.
4.
The learned APP and the learned counsel for Respondent No.2 have vehemently opposed the said Application. 5.
However, after taking into consideration the facts and in the interest of justice, I am inclined to reduce the amount of P.R. Bond and sureties. Hence the following order. 6.
The condition No.(i) of paragraph 7 is hereby modified and the Applicants are directed to furnish P.R. Bond of Rs.3/- Lakhs each with one or two separate solvent sureties in the like amount. Rest of the conditions imposed by the said order are not disturbed. 7.
The Application is allowed in the aforesaid terms. (A.S. GADKARI, J) VRD
