In the past on two occasions the Applicant'

s Appeal was directed to be placed for final hearing on a particular date. The first of such orders is dated 24/03/2015 in Criminal Appeal No.651 of 2001 and the Appeal was directed to be listed peremptorily for final hearing on 21/04/2015 at 03.00 p.m. Digitally signed by MANUSHREE V NESARIKAR Date:

Learned counsel submitted that on that date the matter was not listed. Subsequently again by separate order dated Nesarikar

2 / 2 06-IA-4085-22-IN-APEAL-651-01.odt 18/04/2022 the Appeal was directed to be added to the board on 06/06/2022. Learned counsel submits that even on that day, the Appeal was not listed. The office shall see to it that the orders fixing the matters on a particular date, are followed. 3.

Considering this past history and also taking into account that the Appellant is 73 years of age and since the Appeal is pending since 2001, the Appeal needs to be decided at the earliest.

Therefore following order is passed :

O R D E R

(i) The Appeal be added to the weekly final hearing board commencing from 16/01/2023.

(ii) Interim Application stands disposed of accordingly.
