The learned A.G.P for the State submits that the Government apprehends the execution and implementation of the judgment and award dated 29th December, 2014 passed by the learned District Judge, Khed, Pune in L.A.R. No. 41 of 2007. Hence, the operation, execution and implementation of the impugned judgment and award be stayed till final disposal of the Appeal.

In view of the submission of the learned Government Pleader, the impugned judgment and award is hereby stayed pending Appeal subject to the Government to deposit the entire amount of compensation along with the interest accrued Vishal 1 of 2

910-caf-67-2016.doc thereon within twelve weeks from today before the trial Court. If the amount is not deposited within twelve weeks then the stay granted herewith will stand vacated and the original claimant may proceed with the execution.

After depositing the entire amount, the Respondent/original claimant is allowed to withdraw 50% of the amount which is deposited by the Government with the usual undertaking before the trial Court.

Accordingly, the Civil Application No. 67 of 2016 stands disposed of.
