The prayer of the petitioner to transfer him to open prison was rejected. Petitioner has requested for his transfer from Yerawada Central Prison to Yerawada Open Jail. Since the decision was not taken by the respondent authority at the relevant time, the petition was filed by the petitioner.

Learned APP has tendered across the bar a letter written by the Jail Superintendent Yerawada Central Prison, Pune addressed to the Public Prosecutor, High Court of Bombay Appellate side which is taken on record and marked 'X' for identification.

It is mentioned in the said letter that the petitioner was released on covid parole and after he returns back to the jail, concerned authority Ethape D.A.
