12th January, 2017.
P.C.
The petitioner's contention is that without any objection the Election Commission changed the geographical location of Ganesh Nagar as described in draft ward. In other words it is submitted that Ganesh Nagar area was attached to a different ward while final draft formation was published. Learned Counsel appearing for petitioner placed reliance on the reported judgment in the case of Election Commission of India
2/2 918wp13867.16.sxw through Secretary v/s. Ashok Kumar & others {(2008) 8 Supreme Court Cases 216}.
2.
Learned Counsel appearing for respondent submits that the authorities have not brought any changes suo-moto. Objections were filed. They were looked into and accordingly draft ward formation was finalised and final notification of draft formation was issued. 3.
We have perused the record placed before us and judgment cited supra. We are not inclined to disturb the final ward formation notified by the State Election Commission.
4.
The Election Commission declared the elections in the State yesterday only by issuing proper notification. In the facts no interference is warranted. Writ Petition is dismissed.
