It is an application under Section 439 of Code of Criminal Procedure, 1973.

Applicant is seeking enlargement on bail in Crime no. 425 / 2018 registered with the Samata Nagar Police Station for the alleged offences punishable 1/3

under Sections 307, 326, 323, 504, 506 of the Indian Penal Code, 1860 (IPC for short).

Quarrel ensued between the two drivers on the ground that applicant accused attempted to over pass the lane rule in the course of which, he assaulted the complainant by fist blows and thereafter by knife on the vital parts of his body. Injured had sustained four injuries including that on left side of ribs, left part of the chest and shoulders alongwith the left wrist leading to excessive bleeding. Medical evidence therefore, prima facie shows serious multiple blows and stabs being were inflicted on the vital part of the body of injured that led to his hospitalization for five days.

In view of the evidence on record and the gravity of the offence, the application is rejected. The trial is expedited.
