By consent of the learned counsel for the parties, the following order is passed :

i.

The order of the learned Sessions Judge, imposing cost of Rs. 75,000/- on the Applicant is set aside. ii.

The Applicant shall produce his witness for recording additional evidence before the trial Court at 2.45 p.m. on 28th January, 2015.

The learned Magistrate shall record evidence of the said witness on the same date and if it is not concluded, it shall be continued to be recorded on the next date. iv.

The learned Magistrate shall forward the additional evidence to the Sessions Court immediately after completion thereof.

v.

The learned Sessions Court is directed to forward the record and proceedings to the Magistrate concerned on receipt of an authenticated copy of this order. It is made clear that the anxiety of the court is to see that the Appeal is decided as early as possible and, therefore, both the Judicial Officers are directed to follow this order scrupulously.

Criminal Revision Application is disposed of accordingly.
