Rule. Rule made returnable forthwith. By consent of the parties, the Petition is heard finally and disposed of at the stage of admission.

The Passport Authority is not made a party to the proceedings.

This Petition is directed against the order dated 3rd September, 2018 passed by the learned Metropolitan Magistrate, 72nd Court, Vikhroli, Mumbai in C.C. No. 1270/PW/2016. By the said order, the learned Magistrate has given directions to the Trupti Page 1 of 2
902-wp-4948-2018.doc Passport Authority to consider the Application for renewal of the passport for a period of two years.

The learned counsel for the petitioner submits that the said directions are not to be worded specifically according to it and it can be left to the Passport Authority.

The learned APP submits to the orders of this Court. 6.
In view of this, Rule is made absolute and clause No. 1) a) of the impugned order is modified as follows:
1) a) The applicant Bharat Jayvant Parekh may apply for renewal/ issuance of fresh passport and the Passport Authority may consider the said Application as per rules of the Passport Act.

Rest of the impugned order is maintained.

With this, Writ Petition is disposed of.
