Heard Mr.Ashish Gatagat, learned counsel for the petitioner. He submitted that S.C.Suit No.363 of 2011 was instituted by respondent no.1 for declaring that respondent no.2 herein had flouted and committed breach of letter of appointment dated 12.9.2005. By that letter, respondent no.2 was appointed as Retainer of respondent no.4-Trust.

Mr. Gatagat has tendered photocopy of communication dated 16.7.2014 addressed by respondent no.4-Trust to respondent no.2 informing the latter that in the meeting held on 12.7.2014 the Board of Trustees has decided to terminate retainership arrangement. The said letter is taken on record and marked "X" for identification. Mr.Gatagat submitted that in view of this communication, the suit has become infructuous and this Petition may also be disposed of as such.

In view of the submissions of Mr. Ghatagat, the Petition is disposed of as infructuous. Order accordingly. (R.G.KETKAR, J.)
