DATE : 1 FEBRUARY, 2024 P.C. :- This writ petition is filed by the defendant in an application filed under section 24 of the Maharashtra Rent Act. The defendant prays the decree of eviction from the Competent Authority and so also the Additional Collector, Konkan Division, Mumbai, be set aside.

The present writ petition challenges the order passed by both the authorities. The petition is filed on 8 February, 2016.

KVM 2/2 4 - WP 1169 OF 2017.doc By an order dated 12 December, 2017, the petition was dismissed. By an order dated 29 August, 2019 passed in Civil Application No. 866 of 2018, the writ petition was restored back to the file.

On the last occasions i.e. on 17 January, 2024 and 24 January, 2024, none appeared on behalf of the petitioner. Today when the matter is called out again, nobody appears from the petitioner.

Hence, writ petition is dismissed for want of prosecution. 5.

In view of the dismissal of the writ petition, interim application also stand disposed of.
