Having taken instructions from concerned officer - ACP Mr. J. D. More, learned APP makes a statement that impugned notice issued under section 117 read with section 110 of the Code of Criminal Procedure, 1973 would be withdrawn. Statement is accepted. In view of the statement, grievance of the Petitioner no more survives. The petition is rendered infructuous and the same is therefore dismissed.

Needless to mention that the Respondents are at liberty to take appropriate action against the Applicants on the basis of any fresh material.
