This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 112 of 2022 registered at Chakan Police Station, Pune for the offences punishable under Sections 364(A), 384, 386 r/w. 34 of Indian Penal Code. 3.

The allegations against the present applicant and other coaccused are of extortion. 4.

I have heard the learned Counsel for the applicant and the learned APP for the State.

The bail is sought on the ground of parity. The learned Counsel for the applicant submits that all other co-accused are released on bail.

The learned APP has not disputed that the parity is applicable. The learned APP, however, submits that the applicant is involved in three more crimes, out of which one crime is of similar nature. 7.

Considering the facts and circumstances, I am inclined to release the applicant on bail on certain conditions. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant - Bipin Machindra Kad be released on bail in Crime No. 112 of 2022 registered at Chakan Police Station, Pune for the offences punishable under Sections 364(A), 384, 386 r/w. 34 of Indian Penal Code, on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.

(iii) The applicant shall not enter the limits of Taluka - Khed till conclusion of trial, except to attend the dates before the trial Court.
