Applicant in seeking pre-arrest bail in crime no. 162 of 2018 registered with Chunabhatti Police Station for offence punishable under Sections 498(A), 406, 341, 323, 504 r/w 34 of the Indian Penal Code.
2 922.2281.18 aba.doc On 19/02/2018, Applicant no. 1 Mohammed was married to the Complainant. So far as the remaining accused are concerned, they are in-laws.
Perusal of the F.I.R. depicts that even though necessary ingredients for offence punishable under Section 498 (A) are satisfied, for the ingredients of Section 341 and 406 are concerned, the same cannot be inferred from the contents of the F.I.R. At this stage, the learned counsel for the Applicant, on instructions from the Applicant, volunteers that the amount of Rs. 25,000/- will be deposited with the Investigating Officer within period of two weeks from today.
If the said amount is deposited with the Investigating Officer, the Investigating Officer shall release the said amount forthwith in favour of the Complainant.
If the aforesaid condition is complied with, the Applicant in the
3 922.2281.18 aba.doc event of arrest be released on furnishing P.R. Bond in the sum of Rs. 15,000/- with one surety in the like amount. The Applicant shall not influence or tamper with the evidence. The Applicant shall attend the Investigating Officer as and when directed by the Investigating Officer.
If the aforesaid conditions is not complied with, the protection granted shall cease to operate without further reference to the Court. The Application stands disposed of.
