This Application is moved for restoration of Writ Petition, which was dismissed by this Court by order dated 1st October, 2018 for non-prosecution.

The learned counsel for the applicant submitted that the Writ Petition appeared suddenly on the board and therefore, inadvertently, it went unnoticed. He submitted that the order dated

Considering the submissions, the order dated 1st October, 2018 is hereby restored. Writ Petition is restored to its original file along with the interim order, if any, passed therein. 5.

Issue fresh notice to respondent No. 1, returnable on 21st January, 2019. The petitioner is directed to inform respondent No. 1 within 10 days from today. The compliance of intimation to respondent No. 1 is mandatory and then only, the Petition will be heard finally.

Criminal Application is allowed and is disposed of accordingly. 7.

The Petition is fixed on 21st January, 2019.
