This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No. 49 of 2022 registered at Chakan Police Station, for the ofences punishable under Sections 8(c), 20(b)(ii)(C) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act). 3.
I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

On 10 January 2022, a car bearing no. RJ-14 ZC-3310 (Hyundai I-20) was intercepted and 98 Kgs of Ganja was found in the said car.

The bail is sought on the ground of parity. Learned counsel for the applicant in support of the said ground, has placed on record an order passed by the learned Sessions Court dated 15 July 2022 in Criminal Bail Application No. 331 of 2022. By the said Darshan P. Patil 1/2
78-ba-3674-22.doc order, the Sessions Court has released co-accused Monika Hakim Singh on bail.

I have perused the charge-sheet. The role attributed to the present applicant and co-accused Monika Hakim Singh appears to be identical. I am, therefore, inclined to release the applicant on bail. In the result, the following order is passed.
O R D E R
A] The Application is allowed.
B] The applicant be released on bail in C.R. No. 49 of 2022 registered at Chakan Police Station, for the ofences punishable under Sections 8(c), 20(b)(ii)(C) and 29 of the NDPS Act, on furnishing P.R Bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) with one or two local sureties in the like amount, as the applicant is resident of State of Rajasthan.
