The learned Counsel for the applicant submits that the appeal be heard expeditiously as the original claimant is dead and the applicant is a senior citizen. She submits that this fact is already intimated to the insurance company, however, no steps are taken by it.

In this appeal, there is no claim made against respondent No.2 - owner, who is the opponent No.1 in the Claim. The main contesting party is the deceased claimant.
