Heard learned Counsel for the petitioner.

By this petition under Articles 226 & 227 of the Constitution of India the Petitioner challenges the order dated 15.11.2016 passed by the Member, the Industrial Court, Pune below Exh. U-33.

The learned counsel for the petitioner submits that he received instructions from his client to withdraw the present petitioner with liberty to file appropriate application before the Industrial Court for dismissal of complaint on the ground of infructuous in view of subsequent development. To that effect, he has given in writing on farad. Same is taken on record and marked "X" for its identification.

a) Writ Petition stands disposed of as withdrawn. No order as to costs.

b) Liberty granted to the petitioner to file appropriate application before the Industrial Court, Pune in Complaint (ULP) No. 182 of 2015 for dismissal of complaint on the ground of infructuous in view of subsequent development.

c) For four weeks further proceeding in Complaint (ULP) No. 182 of 2015 is stayed.
