This is an application for anticipatory bail in C.R. No. 87 of 2018 registered with Malwani Police Station, Malad. The FIR was registered for the offences punishable under Sections 419, 498(A), 406 & 34 of Indian Penal Code. The applicant had preferred an application for anticipatory bail before the Sessions Court which has been rejected. Father-in-law and mother-in-law of the complainant was granted anticipatory bail.

Learned APP on instructions submitted during the course of investigation that most of the articles were recovered except Mangalsutra and Ear Rings. It is noted that the dispute is on

Sknair 955-aba-2284-18.odt account of matrimonial discord. The marriage between the applicant and complainant was solemnised on 4th April, 2016. Most of the articles are recovered. According to the learned counsel for the applicant an amount of Rs.2,50,000/- has been handed over to father of the complainant by demand draft. Photo copy of the demand demand has been annexed to this applicant. In the circumstances, custodial interrogation of the applicant is not necessary.

ORDER

i) In the event of arrest of applicant in connection with CR No. 87 of 2018 registered with Malvani Police Station, Malad, Mumbai, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs.20,000/- with one or two sureties in the like amount;

ii) The applicant shall report the concerned Police Station as and when called for by the Investigating Officer between 10.00 a.m. and 12 noon;

iii) The applicant shall not tamper with the evidence and/or influence the prosecution witness;
