P.C. :- Heard learned Counsel for the Applicant. This is an application for restoration of the Second Appeal which was dismissed by a conditional order passed by the Registrar (Judicial) on 20 August 2008. On 31 March 2017 the Appellants were directed to reconstruct the paper-book and thereafter, apply for restoration. The Appellants have reconstructed the paper-book. 2.

Perused the application and I have gone through the

24. CAS. 66.16 .doc reasons set out. Considering the reasons set out, I am of the opinion that the application deserves to be allowed, however, on subject to payment of costs.

Accordingly, the Civil Application is allowed. The Second Appeal (St.) No. 15069 of 2008 stands restored to file, subject to the applicant paying cost of Rs.2,000/- payable to Kirtikar Law Library within period of four weeks. If the cost is not paid, the order dated 20 August 2008 will stand restored. So also, if the objections are not removed within period of four weeks, the order dated 20 August 2008 will stand restored. After the office objections are removed, place the Appeal on board as per its CMIS date. (N.M. Jamdar, J.)
