1] This is an application filed by the State for condonation of delay of 130 days in filing the First Appeal against the Judgment and award dated 24.02.2012 passed by the 4th Joint Civil Judge (Senior Division) in LAR No.181/2001.

2] Notice of the present application was issued to the respondents, but in spite of service, there is no appearance on their behalf. 1/2

4] Scrutiny of proposal for filing Appeal at various levels appears to have caused the delay.

5] Considering the reasons assigned in Para 3 and 4 of the application, I am inclined to condone the delay. In the result, following order is passed :

i] Civil Application No.999 of 2016 is allowed.

ii] Delay in filing the First Appeal is condoned. iii] Office to register the First Appeal and it be listed alongwith the Civil Application No.1000 of 2016 for stay, in due course.
