By the above Miscellaneous Civil Application filed under Section 24 of the Code of Civil Procedure, 1908, the Applicant-wife seeks transfer of Marriage Petition No.A-164 of 2016 filed by the Respondent-husband seeking dissolution of marriage between the Applicant and the Respondent pending before the Court of Civil Judge, Senior Division at Panvel, District-Raigad to the Court of Civil Judge, Senior Division at Kalyan, District-Thane.

The Respondent alongwith his Advocate is present in Court. The Respondent states that he has no objection if the matter is transferred from the Court of Civil Judge, Senior Division at Panvel, District-Raigad to the Court of Civil Judge, Senior Division at Kalyan, District-Thane. In view thereof, the above Miscellaneous Civil Application is allowed and the following order is passed.

kpd 2 / 2 30-MCA-113-2017.sxw (a) The Marriage Petition being No.A-164 of 2016 filed by the Respondenthusband is directed to be transferred from the Court of Civil Judge, Senior Division at Panvel, District-Raigad to the Court of Civil Judge, Senior Division at Kalyan, District-Thane.

(b) The Court of Civil Judge, Senior Division at Panvel, District-Raigad is directed to transmit the papers and proceedings of Marriage Petition No.A-164 of 2016 to the Court of Civil Judge, Senior Division at Kalyan, District-Thane on or before 31st August, 2017.

(c) The parties as well as the Court of Civil Judge, Senior Division at Panvel, District-Raigad and the Court of Civil Judge, Senior Division at Kalyan, DistrictThane to act on an authenticated copy of this Order ; (d) The parties and/or their Advocates shall appear before the Court of Civil Judge, Senior Division at Kalyan, District-Thane on 6th September, 2017 at 11.00 a.m. and obtain necessary orders/directions.
