The State of Maharashtra ... Respondent ATUL GANESH KULKARNI ATUL GANESH KULKARNI Date: 2024.01.02 16:24:33 +0530 Dr. Uday P. Warunjikar with Ms. Sonali R. Chavan for the applicant.

Mr. H.J. Dedhia, APP for the respondent/State. CORAM :AMIT BORKAR, J.

DATED :JANUARY 2, 2024 P.C.:

1.

This Court by order dated 9 June 2023 rejected earlier bail application filed by the applicant. However, this Court directed the Sessions Judge to complete the trial within four months. Liberty was granted to the applicant in case trial is not complete within four months. Accordingly, the applicant has filed present bail application.

2.

The Senior Inspector, Hadapsar Police Station has filed affidavit stating that this Court by order dated 10 October 2023 has granted one year'

s extension for disposal of the bail application. Trial of accused No.2 has been separated by order dated 25 September 2023 and learned advocate for the present applicant sought time to engage new advocate. The vakalatnama

18-ba3502-2023.doc was not filed till 6 November 2023 and, therefore, the Trial Court could not complete the trial within four months. 3.

Considering the reasons stated in the affidavit in reply, it would be in the interest of justice that the Trial Court be directed to decide the trial before 31 May 2024 as five more witnesses are required to be examined. However, it is made clear that no further extension shall be granted and the Trial Court shall, in any event, complete the trial before 31 May 2024.

4.

With this clarification, the bail application stands disposed of.
