On 15th February 2018, this Court had taken note of the fact that the charge-sheet was not filed in compliance of Section 207 Cr.P.C. The investigating officer was not present. It was noticed that the P.M. notes do not find place in the compilation of the chargesheet. In view of this, this Court had issued bailable warrant against the investigating officer in Crime No.269 of 2017, registered at Bharati Vidyapeeth police station, Pune. The investigating officer is present. The warrant has been executed as was directed. Learned APP, upon instructions, submits that on 14th February 2018, the brother-in-law of the investigating officer had

Dusane 2/2 5 ba 2751.2017 expired and hence he could not report to the High Court on 15th February 2018. In view of this, the issuance of the bailable warrant against the investigating officer shall not be taken as an adverse remark against the officer.
