The learned counsel for the first respondent pointed out that the petitioner made an application for intervention before the Chief Metropolitan Magistrate which was rejected by a reasoned order dated 6th December 2014. He pointed out that the said application was rejected by relying upon the decision of the Apex Court in the case of Harshad Govardhan Sondagar vs. International Assets Reconstruction Co. Ltd. & Others1. The learned counsel for the first respondent pointed out that not only that the order dated 6th December 2014 has not been challenged but the said order has been suppressed in this petition. The said order has been annexed to the affidavit in reply filed by the first respondent which is Criminal Appeal No.736/2012 decided on 3.4.2014

tendered on record today.

Hence, writ petition is rejected.
