Learned counsel for the applicant fairly submits that in the present case the Sessions Court had recorded substantive evidence of six witnesses.

In view of this, it would not be appropriate to consider the application under Section 439 of the Code of Criminal Procedure, 1973.

Learned Sessions Judge, Thane ceased with Sessions Case No.48 of 2015 shall make an endeavor to expedite the trial and conclude recording of evidence as early as possible. The application stands disposed of accordingly.
