The applicant has been convicted under Section 302 read with Section 120-B of the Indian Penal Code. The applicant is now seeking temporary bail from 15th to 20th December 2016 on the ground that his sister is getting married and the marriage and other related functions are to take place during this period.

The learned Additional Public Prosecutor pointed out that in the year 2015, the applicant was an under-trial Gaikwad RD 1/2

(902)APPANo.15212016 prisoner and when the applicant was produced in Sessions Court, he threatened the witness. On account of this, Crime Registration No.32 of 2015 came to be registered. This case is still pending. Looking to this fact, we are not inclined to release the applicant on temporary bail.

Application is rejected.
