The applicants, who are accused in Crime No.152 of 2022 registered at Ozar Police Station, Nashik for the ofences punishable under Sections 420, 406, 463, 464, 467, 468, 471, and 120-B read with 34 of the Indian Penal Code have fled these applications under Section 438 of the Code of Criminal Procedure for anticipatory bail.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. 3.
The allegations against the present applicants and other coaccused are of preparing forged Will of the deceased husband of the complainant dated 27 November 2019.

The applicant in ABA No. 3375 of 2022 is a Notary, who had notarized the alleged Will and the applicants in A.B.A. No. 3418 of 2022 are the attesting witnesses on the alleged Will. 5.
The Sessions Court has released the co-accused Bhimabai Bhadke on anticipatory bail, who is the benefciary of the alleged Will. Apart from it, this Court has released the co-accused Dr. Sunil Labade on anticipatory bail, against whom the allegations are of issuing medical certifcate, certifying that the deceased was mentally ft though according to the complainant, at the relevant time, her husband was in ICU. Considering the overall facts and circumstances, I am inclined to release the applicants on anticipatory bail. In the result the following order is passed:
ORDER
A) The Anticipatory Bail Applications are allowed. B) In the event of arrest of the applicants in C.R. No. 152 of 2022 registered at Ozar Police Station, Nashik for the 2/3
ofences punishable under Sections 420, 406, 463, 464, 467, 468, 471, and 120-B read with 34 of the Indian Penal Code, the applicants be released on bail on executing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) each with one or two sureties in the like amount.
