Heard the learned Counsel for the applicant and the learned APP for State. Perused the papers.
This is an application under section 439 of the Code of Criminal Procedure, 1973. The applicant herein is arrested on 12/8/2016 in Crime No. 267 of 2016 registered at Kolsewadi Police Station. The investigation is completed and charge-sheet is filed against the applicant for offence punishable under section 420, 465, 467, 468, 471, 472 read with Section 34 of the Indian Penal Code. 1/3
It is the case of the prosecution that on 12/8/2016 the Branch Manager of Central Bank of India, Kalyan (E), lodged a report at the police station that on that day present applicant alongwith one Shashi Raghuveer Singh @ Sheetal Hadagale had approached the bank for opening new current account. The forms were given. Upon perusal of the forms, it had transpired that the said women wanted to open current account in the name of Hindustan Platinum Private Limited. For some reason, the bank officer suspected the genuineness of the purpose of opening the current account and therefore, had checked the website of Hindustan Platinum and it was transpired that the said account was standing in the name of Choksy Family, which had turnover of Rs. 500 Crore.
There was a discreet enquiry conducted and it had transpired that the documents, which were presented by the applicant for the purpose of opening current account were sham and bogus. That it had further appeared that she and her associates were habitual offender and they had opened several such current accounts.

The learned Counsel for the applicant submits that the applicant is a woman. That she is innocent and had acted at the behest of the co-accused. Taking into consideration the gravity of the offence, allegations levelled against the applicant and the incriminating material collected against applicant in the course of investigation, no sympathy can be extended to the applicant for being woman. The above observations are prima facie in nature and are restricted to the application under section 439 of the Code of Criminal Procedure, 1973 and the same shall not be taken into consideration at the time of trial.
The application being sans merits stands rejected and disposed of accordingly.
