Heard the learned Counsel for the applicants and the learned APP for the State.

This is an application for pre-arrest bail in connection with CR No.127 of 2023, registered with Nagothane Police Station, Raigad, for the offences punishable under Sections 406, 408 and 420 read with Section 34 of Indian Penal Code, 1860 ("the Penal Code").

The learned Counsel for the applicants submits that in ABA/2854/2023 this Court has granted interim protection to the co-accused, who are similarly situated. The applicants 1/2

909-ABA3126-2023.DOC have preferred an application for pre-arrest bail before the Additional Sessions Judge, Mangaon. The application has been preferred on 30th September, 2023. However, the hearing in the said application has since been adjourned as the Presiding Officer is on leave. The applicants are without any interim protection.

In the backdrop of the aforesaid situation, the applicants may not be arrested in CR No.127 of 2023 till the decision of ABA/178/2023 pending before the Court of Session at Mangaon.

Application stands disposed.
